Madras high court declines to stay suspension of 79 DMK MLAs
CHENNAI: DMK’s bid to get a legal reprieve against the suspension of its 79 MLAs from the Tamil Nadu assembly failed on Monday with the Madras high court declining to stay the suspension order.
The first bench of Chief Justice Sanjay Kishan Kaul and Justice R Mahadevan also did not give any interim direction to authorities to allow the suspended MLAs to attend the ongoing session.
The bench, however, issued notice to the assembly speaker. When there was no one to take the notice on behalf of the speaker, the bench allowed the counsel for DMK treasurer M K Stalin and legislator Thiagarajan to serve a private notice on him.
Notices were issued to the government and assembly secretary as well. The government pleader took the notices for them.
A total of 79 MLAs of DMK are under suspension for having criticised and mocked the speaker inside the assembly on August 17. In their challenge, Stalin and Thiagarajan said even those MLAs who didn’t sign the attendance register on August 17 had been suspended and that the en masse suspension was illegal.
